Terms of Service

01 Acceptance of Terms

By accessing tmpirates.com, creating an account, or placing an order (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service. These Terms, together with our Privacy Policy and Refund and Returns Policy, form the complete agreement between you and TM Pirates.

02 Who Can Use TM Pirates

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account or place an order. If you are using the Service on behalf of a minor or with a minor’s payment details, you confirm you are their parent or legal guardian and accept responsibility for that use.

You also confirm that your use of the Service, including any gift card, subscription, or top-up you purchase, complies with the laws of your country and the terms of the platform the product is intended for (for example, regional restrictions on certain gift cards or in-game currencies).

03 Account Registration

Some purchases can be completed as a guest; others require a registered account. When you register, you agree to provide accurate information and to keep your login credentials confidential. You are responsible for all activity that occurs under your account, including orders placed and any wallet balance held on the platform.

We may suspend or terminate an account that provides false information, is used for fraud, or violates Section 9 below.

04 Products We Sell

TM Pirates is a digital goods marketplace. Everything we sell is delivered electronically — there is no physical shipping. Our current catalog spans four categories:

Exact SKUs, denominations, and stock change regularly — the shop page is always the authoritative source for what’s currently available and at what price.

05 Orders & Pricing

Prices are shown at checkout in USD (or your selected currency) and may change at any time without notice; the price charged is the price displayed when you complete payment. By placing an order you make an offer to purchase, which we accept once payment is confirmed and the order status changes to fulfilled.

We reserve the right to refuse, limit, or cancel an order — for example if a listing had a pricing error, if stock of a specific denomination or region runs out, or if we suspect fraud. If we cancel a paid order, you will be refunded to your original payment method or store wallet.

06 Payment Methods

We support a range of regional and global payment rails so customers can pay however is most convenient for them:

All card and crypto payments are processed by our third-party payment providers; TM Pirates does not store your full card number or wallet private keys. By paying, you confirm the payment method belongs to you or that you are authorized to use it.

07 Delivery Policy

Most orders are delivered automatically to your account or the email/order confirmation page within minutes of payment being confirmed — our platform average is under 2 minutes. Some products (certain regional gift cards, manually verified top-ups, or high-value orders flagged for fraud review) may take longer to deliver while we complete verification.

It is your responsibility to check that the email address or account details provided at checkout are correct — we are not liable for non-delivery caused by incorrect contact information supplied by you. If your order hasn’t arrived after a reasonable delivery window, contact support before disputing the charge with your bank or card issuer.

08 Refunds & Cancellations

Because our products are digital codes and credentials that can be used the moment they’re delivered, refund eligibility is more limited than for physical goods. As a general rule:

• An order can usually be cancelled for a full refund only before the code/credential is generated or sent.
• Once a code has been delivered and/or redeemed, the sale is generally treated as final, except where the product itself is faulty, invalid, or was not as described.
• If you receive an invalid, already-used, or non-functioning code, contact support with your order number — we will investigate and issue a replacement or refund where we confirm the fault is on our end.
• Refunds, where approved, are issued to your original payment method or as store wallet credit, at our discretion and subject to any fees charged by the payment provider.

09 Prohibited Conduct & Fraud

You agree not to:

• Use a stolen, unauthorized, or fraudulently obtained payment method;
• File a chargeback or payment dispute for an order that was correctly delivered, instead of contacting support first;
• Resell, redistribute, or bulk-purchase products in a way that violates the issuing platform’s own terms (for example, reselling subscription credentials in breach of that provider’s policy);
• Attempt to exploit pricing errors, bugs, promo codes, or the wallet system for financial gain;
• Use automated tools (bots, scrapers) to place orders or scrape pricing/stock data without permission;
• Interfere with the security or normal operation of the Service.

10 Third-Party Platforms

TM Pirates is an independent reseller of digital codes, gift cards, and subscription credentials. We are not owned by, operated by, or officially affiliated with Netflix, Amazon, Spotify, Disney, Google, Apple, Valve/Steam, Sony/PlayStation, Microsoft/Xbox, Razer, or any other platform, publisher, or brand referenced on our site. All product names, logos, and trademarks belong to their respective owners and are used only to identify the products we sell.

Your use of any redeemed subscription, gift card, or in-game currency is also governed by that platform’s own terms of service, which we do not control and are not responsible for.

11 Intellectual Property

The TM Pirates name, logo, website design, and original content are the property of TM Pirates and may not be copied, scraped, or reused without permission. Third-party trademarks referenced on the site remain the property of their respective owners as noted in Section 10.

12 Disclaimer of Warranties

The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or that every product will be available at all times.

13 Limitation of Liability

To the fullest extent permitted by law, TM Pirates and its officers, employees, and partners will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability for any claim relating to an order is limited to the amount you paid for that specific order.

Nothing in these Terms limits liability that cannot be excluded under applicable law, such as liability for fraud or gross negligence.

14 Indemnification

You agree to indemnify and hold TM Pirates harmless from any claim, loss, or damage — including reasonable legal fees — arising from your misuse of the Service, your violation of these Terms, or your violation of any third-party platform’s terms in connection with a product purchased from us.

15 Privacy

Our collection and use of your personal information — including account details, order history, and payment metadata — is described in full in our Privacy Policy, which forms part of these Terms.

16 Governing Law & Disputes

These Terms are governed by the laws of [Bangladesh], without regard to conflict-of-law principles. Before pursuing a formal claim, you agree to first contact support@tmpirates.com so we can attempt to resolve the issue informally.

17 Changes to These Terms

We may update these Terms from time to time to reflect changes to our products, payment methods, or legal requirements. The “Last updated” date at the top of this page will change accordingly. Continuing to use the Service after an update constitutes acceptance of the revised Terms — for material changes, we will make reasonable efforts to give notice, such as a banner on the site.

18 Severability

If any provision of these Terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will stay in full effect.
